Managers are obliged to personally identify the guests of their Accommodation Facilities
ref. Article 109 of the Testo Unico delle Leggi di Pubblica Sicurezza (TULPS).
The personal identification of guests is an obligation to ensure public safety.
The identification of guests enables the police to constantly monitor the presence of people in the area and to prevent any illegal activities. The verification of documents is essential to protect citizens by guaranteeing their safety and also because it is a legal obligation, failure to comply with this regulation results in administrative sanctions.
Practices such as online check-in or the use of automatic recognition systems do not comply with the law and do not exempt the manager from the responsibility of verifying the identity of the guest.
What should accommodation managers do?
1 Verify documents: When checking in, the manager must request a valid ID from each guest and verify that it matches the person present;
2 Transmit notification to the competent Police Headquarters within 24 hours of the guest’s arrival (or within 6 hours for stays of less than 24 hours) using the methods indicated by the Ministry of the Interior.
3 Update the ‘Alloggiati Web’ portal according to the methods indicated in the Ministry of the Interior Decree of 07/01/2013, as amended by the Ministry of the Interior Decree of 16/09/2021.
Online platforms for home exchange (such as Airbnb) are also subject to these obligations. Guest data must be entered in the ‘Alloggiati Web’ portal.
Affected by the regulation are hotels, bed and breakfasts
guest houses, holiday homes, online platforms
for house exchange and marina resorts.

The obligations under DA No. 1783 of 27/07/2022 for accommodation facilities
The Councillor’s Decree provides for the obligation to communicate daily, via the ‘Turist@t’ tourist flow management system, the data relating to arrivals and presences, for the purposes related to the obligation to communicate the movement of customers in accommodation facilities for ISTAT purposes.
The owners of accommodation facilities or rented accommodation, as well as those who carry out real estate intermediation activities or manage telematic portals or websites, are required to publish the CIR code of each facility in their announcements, advertisements and bookings.
The CIR must be clearly visible next to the name. The obligation concerns any promotional medium, even platforms hosted by servers located outside the territory of the European Union.
The owners of accommodation facilities will have to comply with the provisions of the decree within 30 days of the CIR being issued by the Sicilian Region.
